Terms of Service

1. About Us

These Terms of Service apply to all orders placed with Edible Canopy.

We are a small, independent nursery specialising in plants for edible and productive growing systems. If you have any questions, please contact us using the details provided on our website.

2. Our Plants

We supply live plants intended for cultivation, many of which are suitable for human consumption.

As living material, plants naturally vary in size, shape, and appearance depending on season, growing conditions, and stage of growth. Some plants may be supplied in a dormant state at certain times of year.

Images on our website are provided as a guide only and may not represent the exact plant received.

While many of our plants are edible, methods of preparation and consumption vary between species. We recommend that customers carry out their own research to ensure appropriate and safe use of any plant purchased.

We are unable to accept responsibility for:

  • The use or application of plants after delivery
  • Incorrect identification, preparation, or consumption
  • Outcomes resulting from insufficient or inaccurate information sourced by the customer

3. Orders

All orders are subject to acceptance and availability.

As a small nursery working with seasonal stock, there may be occasions where we are unable to fulfil an order. In such cases, we will notify you promptly and issue a full refund.

We reserve the right to refuse or cancel orders where necessary.

4. Pricing & Payment

All prices are shown in GBP (£). Payment is taken at the time of ordering.

Prices reflect the cost of growing, maintaining, and carefully preparing live plants for dispatch.

5. Delivery & Shipping

We deliver within the UK only. Full details of delivery methods, costs, and conditions are set out in our Shipping Policy.

We take care to ensure plants are well prepared and packaged for transit.

6. Cancellations

Orders may be cancelled within 24 hours of being placed.

After this period, orders enter preparation and dispatch processes and cannot be cancelled due to the perishable nature of the goods.

Under the Consumer Contracts Regulations 2013, live plants are exempt from standard cancellation rights applicable to non-perishable goods. This does not affect your statutory rights.

7. Refunds & Issues

If there is an issue with your order, please contact us as soon as possible. Full details of how we handle problems with orders are set out in our Refund Policy.

Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.

8. Customer Responsibilities

By placing an order, you agree to:

  • Provide accurate and complete delivery information
  • Ensure suitable arrangements are in place to receive delivery
  • Inspect plants promptly upon receipt
  • Provide appropriate care based on the needs of the plant

Once delivered, plant performance is dependent on environmental conditions and care provided.

9. Liability

We take care to supply healthy plants and to package them appropriately for transport.

However, we are not responsible for:

  • Plant performance after delivery
  • Losses resulting from environmental conditions or care practices
  • Delays or handling issues once orders have been dispatched

We remain fully compliant with our obligations under the Consumer Rights Act 2015, including where goods are faulty, not as described, or not fit for purpose.

10. Events Outside Our Control

We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control. This may include, but is not limited to:

  • Severe weather conditions
  • Courier delays or disruptions
  • Supply chain or seasonal availability issues

11. Collection

Collection is available from Edible Canopy Nursery by prior arrangement.

If plants are not collected within 6 weeks of our initial contact, the order will be considered abandoned. Due to the perishable nature of the goods, refunds will not be issued in such cases.

12. General

These Terms of Service may be updated from time to time.

These terms are governed by the laws of England and Wales.
